Automation & Non-Advisory Agreement

1. Nature of the Software

AI Predicted Signals is a software automation tool that enables users to automate cryptocurrency trading on third-party exchanges. The Service is:

• A technology platform that executes trades based on user-configured parameters and AI-generated signals
• A non-custodial tool that connects to your exchange account via trade-only API keys
• A software product comparable to spreadsheet software, programming tools, or other productivity applications

The Service is not:

• A financial advisory service
• An investment management or portfolio management service
• A broker-dealer or securities exchange
• A managed trading account or fund
• A provider of personalized financial recommendations

2. No Fiduciary Relationship

NO FIDUCIARY, ADVISORY, OR TRUST RELATIONSHIP EXISTS BETWEEN AI PREDICTED SIGNALS AND ITS USERS.

By using the Service, you acknowledge and agree that:

• We do not owe you any fiduciary duty, duty of care, or duty of loyalty
• We do not act as your agent, trustee, or representative in any capacity
• We have no obligation to act in your best financial interest
• Our relationship is strictly that of a software provider and a software user
• We do not know your personal financial situation, risk tolerance, investment objectives, or tax circumstances

3. User Configuration and Control

You are solely responsible for configuring and controlling all aspects of your trading activity on the Service, including:

• Strategy Selection: Choosing which strategy presets or custom configurations to use
• Risk Parameters: Setting stop-loss levels, take-profit targets, and position sizes
• Capital Allocation: Determining how much capital to allocate to automated trading
• Pair Selection: Choosing which cryptocurrency pairs to trade
• Bot Management: Starting, stopping, and monitoring your trading bots
• Trading Mode: Choosing between paper trading (simulated) and live trading
• Exchange Selection: Choosing which exchange to connect and trade on

While the Service provides strategy presets and default values for convenience, you are responsible for reviewing and adjusting all parameters to suit your own risk tolerance and financial situation.

4. Signals Are Statistical Outputs, Not Recommendations

The AI-generated signals provided by the Service are:

• Statistical outputs generated by machine learning models analyzing historical market data
• Pattern-based predictions that reflect probability estimates, not certainties
• Automated outputs generated without human review of each individual signal
• Not personalized to your individual financial situation, goals, or risk tolerance

SIGNALS DO NOT CONSTITUTE INVESTMENT ADVICE, FINANCIAL RECOMMENDATIONS, OR ENDORSEMENTS OF ANY PARTICULAR TRADE. THEY ARE DATA POINTS THAT YOU MAY CHOOSE TO USE OR IGNORE AT YOUR SOLE DISCRETION.

5. User Custody of Funds

You maintain full custody and control of your funds at all times:

• Your funds are held on your exchange account, not by AI Predicted Signals
• We require trade-only API keys that cannot withdraw or transfer your funds
• You can revoke API key access at any time through your exchange account settings
• We never have direct access to your exchange account credentials (username/password)
• The security of your funds depends on the security of your exchange and your own account practices

6. Trade-Only API Key Requirement

To protect your funds, we enforce the following API key policy:

• API keys must be configured with trade permissions only
• Withdrawal permissions must be disabled on all API keys used with the Service
• We recommend restricting API keys to specific IP addresses where supported by your exchange
• API keys are encrypted at rest and stored with a 90-day inactivity expiration

If you provide an API key with withdrawal permissions enabled, you do so entirely at your own risk. We strongly advise against this.

7. Emergency Stop and Safety Features

The Service provides safety features including:

• User-configurable stop-loss and take-profit levels per bot
• The ability to stop individual bots or all bots at any time
• Performance guard that can automatically pause bots based on drawdown or loss thresholds
• Capital allocation limits per bot and per account

However, these safety features have limitations and are not guaranteed to prevent losses. See our Risk Disclosure for a detailed explanation of these limitations. You should always maintain the ability to manually intervene on your exchange account as a backup.

8. No Guarantees of Performance

WE MAKE NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES REGARDING THE PROFITABILITY, ACCURACY, OR RELIABILITY OF THE SERVICE, ITS SIGNALS, OR ITS AUTOMATED TRADING FUNCTIONALITY.

Specifically, we do not guarantee:

• Any specific rate of return, win rate, or profit level
• That the Service will outperform manual trading, other services, or holding assets
• Continuous, uninterrupted, or error-free operation
• That signals will be delivered in time for optimal execution
• That automated bots will execute trades exactly as configured in all market conditions

9. Assumption of Risk

By using the Service, you voluntarily assume all risks associated with:

• Cryptocurrency trading and market volatility
• Automated trading systems, including software errors and execution failures
• AI-generated signals that may be inaccurate or unprofitable
• Third-party exchange risks including outages, hacks, and insolvency
• Regulatory changes that may affect your trading activity
• Loss of some or all of your invested capital

You represent that you understand these risks and have the financial capacity to bear potential losses.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Predicted Signals, its operator (Maithamali Akil Jiwan), affiliates, officers, employees, agents, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service and its automation features; (b) your trading activities and decisions; (c) your violation of this Agreement or any applicable law; (d) your configuration of API keys, risk parameters, or trading bots; or (e) any dispute between you and a third-party exchange.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO TRADING LOSSES, LOST PROFITS, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

12. Relationship to Other Legal Documents

This Automation & Non-Advisory Agreement supplements and should be read in conjunction with our:

• Terms of Service — general terms governing use of the Service
• Privacy Policy — how we collect, use, and protect your data
• Risk Disclosure — detailed risks of cryptocurrency trading and AI-generated signals

In the event of a conflict between this Agreement and the Terms of Service, the more specific provision shall control.
